1. Introduction

These Terms & Conditions (“Terms”) govern your use of the Project Problems - AI Risk Management service (the “Service”), provided by H. Wild (“we”, “us”, “our”). By accessing or using the Service, you agree to be bound by these Terms.

Our AI agents autonomously analyze project-related information to surface potential risks. The Service is in beta and intended for pilot testing purposes only.

3. Data Usage & Sharing

By using the Service, you authorize us to process and share your provided data with third-party service providers (e.g., AI model hosts such as OpenAI) strictly for the purpose of delivering the Service. We will, to the fullest extent possible:

• Mark and handle your data as “non-training” input, preventing it from being used to further train or improve the underlying AI models.
• Ensure third-party processors comply with applicable data protection laws, including GDPR for EU users and relevant US regulations.

You remain responsible for ensuring your data sharing does not violate any confidentiality agreements, privacy laws, or third-party rights.

4. No Guarantees & Disclaimers

• The Service is provided “as is” and “as available”; we disclaim all warranties, whether express or implied.
• We do not guarantee completeness, accuracy, or fitness for a particular purpose of any risk assessments.
• Your use of the Service is at your own risk; we bear no liability for decisions based on its output.

5. Limitation of Liability

To the maximum extent permitted by law, we and our partners shall not be liable for any:

• Indirect, incidental, special, consequential or punitive damages.
• Loss of profits, data, business opportunities, or goodwill.
• Claims arising from your misuse or reliance on the Service outside these Terms.

6. Intellectual Property

All Service content, software, and underlying algorithms remain our exclusive property. You may not copy, reverse engineer, modify, or redistribute any part of the Service without prior written consent.

8. Governing Law & Jurisdiction

These Terms are governed by German law. For users outside Germany, disputes will be resolved in the courts of Darmstadt, Germany, unless mandatory local law dictates otherwise.
